You will have 24 hours to get under the hard cap. After which you will begin being penalized 2,500,000*x over x years, with x being the number of days you've been over the cap. Example: dump goes over the hard cap and remains that way for 72 hours. He is penalized 7.5 million for 3 years. This rule will not be in effect during the off season.
The Mike Rule: If you go over the hard cap due to a trade or signing and the trade deadline has passed, that trade will be veto'd and/or the signing will be reversed. And under any circumstance not clear under these rules, the commish has the ability to act in any way he wishes. So don't go over the hard cap, otherwise you're screwed. Simple.
